The evidence you need to prove your property is free of Legionella risks

A Landlord, by law, is not required to get a legionella risk assessment or certificate. However, Section 3(2) of the Health and Safety at Work Act 1974 (HSWA) makes Landlords responsible that tenants are not exposed to health and safety risks in their property.

WHAT IS LEGIONELLA?

Legionella is type of bacteria naturally found in freshwater. It can contaminate hot water tanks, hot tubs, and cooling towers of large air conditioners. Legionella is spread by breathing in contaminated water vapour which will lead to Legionnaires’ disease.

WHY SHOULD YOU TEST FOR LEGIONELLA?

In this scenario, you would have to provide evidence that you have taken preventive measure such as a legionella test to show that you have undertaken your legal responsibilities.
