Legionella Testing

The evidence you need to prove your property is free of Legionella risks

A Landlord, by law, is not required to get a legionella risk assessment or certificate. However, Section 3(2) of the Health and Safety at Work Act 1974 (HSWA) makes Landlords responsible that tenants are not exposed to health and safety risks in their property.

If your tenant was to contract Legionnaires’ disease in your rented property because of the water system. You would be liable to being prosecuted by the tenant

WHAT IS LEGIONELLA?

Legionella is type of bacteria naturally found in freshwater. It can contaminate hot water tanks, hot tubs, and cooling towers of large air conditioners. Legionella is spread by breathing in contaminated water vapour which will lead to Legionnaires’ disease.

WHY SHOULD YOU TEST FOR LEGIONELLA?

A Landlord, by law, is not required to get a legionella risk assessment or certificate. However, Section 3(2) of the Health and Safety at Work Act 1974 (HSWA) makes Landlords responsible that tenants are not exposed to health and safety risks in their property. If your tenant was to contract Legionnaires’ disease in your rented property because of the water system. You would be liable to being prosecuted by the tenant.

In this scenario, you would have to provide evidence that you have taken preventive measure such as a legionella test to show that you have undertaken your legal responsibilities.

WHAT WE'RE HERE TO DO

Once this has been completed another test would be required to be sure that the risk is low again and that you have the right documentation that supports this.

This will ensure that you are complying with your duties as required by law.
