WHY SHOULD YOU TEST FOR LEGIONELLA?
A Landlord, by law, is not required to get a legionella risk assessment or certificate. However, Section 3(2) of the Health and Safety at Work Act 1974 (HSWA) makes Landlords responsible that tenants are not exposed to health and safety risks in their property. If your tenant was to contract Legionnaires’ disease in your rented property because of the water system. You would be liable to being prosecuted by the tenant.
In this scenario, you would have to provide evidence that you have taken preventive measure such as a legionella test to show that you have undertaken your legal responsibilities.
